Do Kwon, Terraform Labs Face Class-Action Lawsuit For Allegedly Selling Unregistered Securities

While most of the crypto economy’s digital assets have seen significant gains this month, Terra’s luna 2.0 has been stagnant as it has shed 24.37% against bitcoin during the last 30 days. LUNA is down 89.8% from the token’s all-time price high two months ago on May 28. Moreover, the whistleblower Fatman has revealed that victims of the Terra collapse have filed a class-action lawsuit against Terraform Labs, Do Kwon, and Nicholas Platias.

Crypto Whistleblower Fatman Reveals Getting Involved in Terra Lawsuit so ‘Justice Can Take Its Course’

On July 26, the whistleblower Fatman (@Fatmanterra on Twitter) shared a sign-up link for investors who were hurt financially by the Terra collapse in mid-May. The case is being handled by the litigation firm Scott+Scott and the defendants include Terraform Labs (TFL), Nicholas Platias, and Do Kwon. Furthermore, Jump Crypto, Jump Trading, Republic Capital, Republic Maximal LLC, Tribe Capital, Definance Capital, GSR Markets Limited, Three Arrows Capital (3AC), and the Luna Foundation Guard (LFG) are included.

In Fatman’s Twitter thread that discusses the lawsuit, the whistleblower complimented Do Kwon’s intellect but noted that the Terra co-founder did not use it for good. “Instead of using his genius for good, Do used it to create a scheme so convincing, ingeniously mixing in real utility with sheer lies, that it not only led to the downfall of thousands of investors but also some big funds who had been hoodwinked in spite of solid research,” Fatman remarked in the thread. We will be joining the class action lawsuit filed in the U.S. by the international law firm Scott+Scott. We are also preparing actions in another jurisdiction. We demand a fair trial to uncover all of TFL [and] Do Kwon’s wrongdoings and so that justice can take its course.

LUNA 2.0 Markets Flounder, South Korean Authorities Investigate Terra Co-Founders Do Kwon and Daniel Shin

While the class-action lawsuit participants prep for the case against TFL, the project’s luna 2.0 token called LUNA has not been performing as well as most of the crypto economy. LUNA has lost 24.37% against bitcoin (BTC) since last month and 9.62% against the U.S. dollar in the same time frame. Out of 13,099 crypto coins in existence, LUNA is ranked 148 with its $261.63 million market valuation. Since LUNA’s all-time high on May 28 when it reached $18.87 per unit, LUNA has lost 89.8% in USD value.

LUNA has significant exposure to tether (USDT) pairs as cryptocompare.com statistics indicate that USDT represents 77% of all LUNA’s trades during the last 24 hours. USDT is followed by USDC (11.43%), TRY (9.57%), USD (0.68%), and EUR (0.37%). Additionally, LUNA’s total value locked (TVL) in the world of decentralized finance (defi) is $26.88 million while just over $12 million is still held in defi protocols on the Terra Classic chain. In addition to the Scott+Scott lawsuit, Terra’s co-founder Daniel Shin is banned from leaving South Korea.

South Korean law enforcement officials are investigating TFL, Shin, and Kwon and Fatman say a rough translation of the article details that “the prosecutor also brought up the possibility of cooperating with Interpol to issue a Red Notice for Do Kwon’s extradition.” The class-action complaint published by Scott+Scott claims all of the Terra tokens TFL has issued are unregistered securities and TFL never registered with the Securities and Exchange Commission (SEC). In Fatman’s Twitter thread, the whistleblower stressed that it was hard to convey how badly some Terra investors were affected by the collapse. Fatman’s Twitter thread concluded by noting:

It’s time to take matters into our own hands. I’m sick of seeing our space invaded by scammers who think they can brazenly rob thousands of innocents and get away with it. People like Do Kwon make this industry rotten. It’s time for a purge so crypto can be reborn anew.

Yuga Labs Sues Artist Ryder Ripps For ‘Scamming Consumers’ And Misusing Bored Ape Trademarks

The creators of the popular non-fungible token (NFT) project Bored Ape Yacht Club (BAYC), Yuga Labs, have sued the artist dubbed Ryder Ripps and collaborators for attempting to devalue the BAYC brand. Yuga Lab’s lawsuit claims Ripps and associates trolled the company and started “scamming consumers into purchasing RR/BAYC NFTs by misusing Yuga Labs’ trademarks.

Yuga Labs Files Lawsuit Against Ryder Ripps, Aims to ‘Fight Against Slanderous Claims’

A lawsuit has been filed by Yuga Labs in the state of Califonia against the artist Ryder Ripps and a few associates. The company spoke about the lawsuit on June 24 via Twitter and said that support from the community was “overwhelming.”

“We will continue to be transparent with our community as we fight these slanderous claims,” Yuga Labs said. “In order to put a stop to the continuous infringement, and other illegal attempts to bring harm to us and the BAYC community, we have filed a lawsuit against the responsible parties. We will continue exploring and pursuing all legal options at our disposal.”

Yuga Labs accuses Ryder Ripps of “seeking to devalue” official BAYC NFTs with a copycat collection called RR/BAYC NFTs. The lawsuit claims that original BAYC images were used and Ripps is accused of marketing the NFTs as official BAYC products.

Yuga Labs’ trademarks were also allegedly used in Ripps’ “Ape Market” NFT marketplace. The lawsuit adds that this is “no mere monkey business” and that Ripps’ actions were a “deliberate effort to harm Yuga Labs at the expense of consumers.”

During the first week of February, Ryder Ripps accused Yuga Labs’ trademarks of having “Nazi ties.” Yuga Labs co-founder Gordon Goner responded to the accusations in a Medium blog post and stressed that the allegations are “insanely far-fetched.”

The blog post gives a full summary of why the BAYC creators chose to use Apes, the inspiration behind the design of the BAYC logo, and the company name, Yuga Labs. The lawsuit accuses Ripps and several cohorts of “perpetuating a scam.”

The lawsuit notes that Ripps claims his actions are “satire,” but Yuga Labs insists Ripps raked in millions of ill-gotten profit from the RR/BAYC NFT collection. Yuga Labs believes Ripps and the collection will continue to damage the business. Ripps continues to tweet about the alleged connection between specific symbols Yuga Labs leverages.

The RR/BAYC NFT collection’s creator also tweeted about the “terms people who purchased RR/BAYC’s agreed to” which says the customer “understands that this is a new mint of BAYC imagery, re-contextualizing it for educational purposes, as protest and satirical commentary.”

Do Kwon Accused Of Cashing Out $2.7B Before UST Collapse, Terra Founder Says Allegations Are False

Terra’s new LUNA 2.0 token has lost 54% in value in the last two weeks, after reaching $11.33 per unit on May 30. Meanwhile, the whistleblower Fatman has accused Terra’s co-founder Do Kwon of cashing out $2.7 billion a few months before the UST de-pegging incident. Kwon, however, has been keeping tabs on Fatman’s accusations and he claims the allegations are “categorically false.”

LUNA 2.0 Token Drops 54% in Value During the Last 2 Weeks

The LUNA 2.0 rebirth token has been extremely lackluster in terms of market performance during the past two weeks. However, as Bitcoin.com News reported six days ago, a myriad of decentralized finance (defi) protocols have re-joined the ecosystem.

Terra’s 2.0 chain has roughly $1.32 billion locked in the Stader defi application according to defillama.com stats. The Terra Classic chain still has $10.54 million total value locked in defi today as well, with $3.11 million held on Terraswap and $2.47 million locked into Anchor.

During the past two weeks, after LUNA 2.0 tapped a high of $11.33 per unit, the new LUNA has lost 54% during the last 14 days. It is still down 86% from the all-time high at $18.87 per coin when the 2.0 blockchain was first launched.

At the time of writing, LUNA 2.0 has $135 million in global trade volume, which pales in comparison to the volume luna classic (LUNC) saw prior to the fallout. The top exchanges in terms of trade volume for LUNA 2.0 include Bitrue, Okx, Huobi Global, Kucoin, and Gate.io. LUNA 2.0’s top five trading pairs today include USDT, USD, USDC, EUR, and ETH, respectively.

Terra Co-Founder Do Kwon Continues to Be Accused of Shady Acts — Whistleblower Fatman Claims Kwon Cashed Out $2.7 Billion Before UST Collapse

While LUNA’s market performance has not been so hot, alongside a variety of crypto assets suffering through the bear market, Do Kwon is still being accused of shady acts by the whistleblower Fatman.

Should we start using the term Kwonzi more often? I propose a definition.

Three days ago, Bitcoin.com News also reported on the U.S. Securities and Exchange Commission (SEC) reportedly investigating the terrausd (UST) collapse and the company Terraform Labs (TFL). On June 11, 2022, Fatman accused Kwon of siphoning $2.7 billion from the Terra project a few months before the UST fallout.

“Some of you thought $80m per month was bad,” Fatman tweeted. “That’s nothing. Here’s how Do Kwon cashed out $2.7 billion (33 x $80 [million]) over the span of mere months thanks to Degenbox: the perfect mechanism to drain liquidity out of the LUNA [and] UST system and into hard money like USDT.”

Fatman says the defi borrowing protocol Abracadabra’s Degenbox and tokens like SPELL and MIM were used to provide “deeper exit liquidity to the UST pair.” The whistleblower said that Kwon was able to cash out via the MIM/UST pool to the tune of $2.719 billion without moving the peg.

“UST is the future, he said. Decentralized money is sound money, he said,” Fatman continued. “UST won’t de-peg, he told you. ‘Centralized stablecoins will rug you eventually.’ So why did he cash out $2.7b from UST into USDT and USDC?”

Do Kwon Refutes Cash Out Accusations, Says He ‘Really Doesn’t Care About Money Much’

However, Do Kwon has refuted the claims he cashed out $2.7 billion before the UST crash. “This should be obvious, but the claim that I cashed out $2.7B from anything is categorically false,” Kwon said the same day Fatman accused him. Kwon also has his Twitter account set to private mode and only people Kwon tags in a tweet can reply.

“Two contradictory claims seem to exist where: Do’s wallets are doxxed, and he still owns most of his luna through the airdrop [or] Do dumped all his tokens to make billions,” Kwon continued. “A lane should ideally be picked.” The Terra co-founder added:

To reiterate, for the last two years the only thing I’ve earned is a nominal cash salary from TFL, and deferred taking most of my founder’s tokens because a) didn’t need it and b) didn’t want to cause unnecessary finger-pointing of ‘he has too much.’

On Twitter, people have discussed how Kwon is a lot more humble now in comparison to calling people “poor” during LUNA’s peak fame. Others have been discussing Kwon reportedly “bending over” Abracadabra founder Daniele Sesta and “SPELL bagholders.”

The claims say tokens like SPELL, MIM and Abracadabra’s Degenbox were used to help Kwon siphon UST into harder stablecoin assets. Abracadabra and Sesta have already had their share of controversy in the past with the Wonderland TIME debacle.

Terra’s co-founder Kwon stressed on Twitter that none of what is being said about him cashing out is true. “Hope that’s clear – I didn’t say much because I don’t want to seem like playing victim, but I lost most of what I had in the crash too,” Kwon concluded on Saturday in his refutation against the claims he cashed out $2.7 billion.

“I’ve said this multiple times but I really don’t care about money much. Please say things that are proven and true – if you are spreading falsehood that just adds to the pain of everyone who has lost,” Kwon added.

Meanwhile, Fatman continues to accuse Kwon of dirty tricks and the whistleblower has not stopped criticizing Kwon’s ostensible acts, or his current commentary and refutation.

LUNA 2.0 Token Loses 56% Since Last Week, Whistleblower Accuses Terraform Labs Of Owning Shadow Wallets

After climbing to $11.33 per unit seven days ago on May 30, Terra’s new LUNA 2.0 token has lost more than 56% in value against the U.S. dollar. Amid the market performance, a number of former Terra-based decentralized finance (defi) projects are transitioning over to the new Phoenix-1 blockchain. In addition to the defi projects re-joining the Terra ecosystem, the whistleblower known as Fatman continues to accuse Terraform Labs (TFL) and Do Kwon of manipulative tactics such as allegedly lying about making LUNA 2.0 community-owned. Fatman alleges Kwon and TFL have access to shadow wallets with 42 million new LUNA tokens.

LUNA 2.0 Token Sheds 56% Since Last Week’s Price High, Terra Defi Apps Join the New Phoenix Blockchain

Last week, the price of Terra’s LUNA 2.0 token was in better standings as the value crept up to $11.33 per unit last Monday. Since then, however, LUNA is down 56.92% since the high on May 30, 2022. Today, 24-hour price range statistics indicate that LUNA has ranged between $4.84 to $5.46 per coin.

Out of more than 13,400+ cryptocurrencies in existence today, LUNA’s market capitalization is ranked 2,806 and it has seen $380 million in global trade volume during the last 24 hours. The top five trading pairs with LUNA on June 6, 2022, includes USDT, USD, EUR, USDC, and ETH respectively.

Amid the market performance during the last week, a number of defi applications that were once very prominent apps on Terra are prepping to re-join or have already joined the new 2.0 system. This includes Terra defi apps like Valkerie Protocol, Leap Wallet, and Astroport.

The Terra Twitter page recently explained that the Terra Bridge Version 2 is now live and with the latest version, “users can transfer assets to [and] from Terra 2.0, Ethereum, Osmosis, Secret, Cosmos, [and] Juno.” The Terraform Labs co-founder Do Kwon tweeted about the decentralized exchange (dex) Phoenix and the staking derivative application Stader launching on Terra 2.0.

Terra Whistleblower Accuses Do Kwon and Terraform Labs of Owning Shadow Wallets

While Terra community members rebuild the obliterated blockchain ecosystem, the whistleblower Fatman continues to accuse Terraform Labs and Do Kwon of manipulation. On June 6, Fatman said that Terraform Labs and Do Kwon allegedly have shadow wallets, even though the team promised specific wallets like the Luna Foundation Guard’s and TFL’s wallet would be blacklisted from the LUNA 2.0 airdrop.

“Do Kwon has stated numerous times that TFL has zero new LUNA tokens, making Terra 2 ‘community-owned,’” Fatman tweeted. “This is an outright lie that nobody seems to be talking about. In fact, TFL owns 42M LUNA, worth over $200m, and they’re lying through their teeth.”

Fatman also disclosed five wallets he suspects are shadow wallets which include 1, 2, 3, 4, and 5 Terra-based addresses. The five wallets hold 42.81 million LUNA 2.0 tokens and Fatman claims there are many other wallets. Three out of the five wallets have moved LUNA while the other two have remained inactive.

“[Do Kwon] used his shadow wallet to approve *his own proposal* through governance manipulation (TFL is not supposed to vote), told everyone it would be a community-owned chain, and then gave himself a nine-figure score. These are just the verified wallets – there are many others,” the whistleblower wrote.

However, in another Twitter thread, Fatman detailed that there’s a possibility Terra 2.0 could become a community-owned blockchain. But Fatman wholeheartedly believes Terraform Labs (TFL) is not letting this concept come to fruition.

“Terra 2 may succeed as a truly community-owned chain, but it appears TFL is hell-bent on making sure this doesn’t happen,” Fatman said. “I hope things change, but multiple builders are reporting that the chat is in complete disarray and there is a lot of pent-up resentment towards [Do Kwon].”
